Delegated committees

Delegated committees are established by Council under section 63 of the Local Government Act 2020 (the Act) through an Instrument of Delegation.

The Instrument of Delegation allows the Committee members to exercise the power to make certain decisions 'as if it were Council'.

Community asset committees

Community asset committees are established under section 65 of the Act by Council to manage a community asset in the municipal district.

Under section 47(1) of the Act, the Chief Executive Officer through an Instrument of Delegation, may delegate to the members of a community asset committee the power to make certain decisions on behalf of the organisation relating to management of a community asset in the municipal district.

Councillor representative(s) are not required on community asset committees.

Advisory committees provide advice and recommendations on strategic matters to help inform Council decision-making.

Membership usually comprises of community and organisational representatives that live, work, and/or study in the City of Ballarat and have the necessary skills and expertise to contribute to fulfilling the purpose of the committee.

Councillor representative(s) hold membership on advisory committees and are appointed by resolution of Council at the end of each year.

Advisory committees have no delegated powers to act in place of Council. The recommendations of advisory committees have no standing unless they are adopted by Council at a formal meeting.
