Amendment C169 - Proposed Ballarat Grammar Educational Campus, Mount Rowan

 

Approval of Amendment by the Minister for Planning

The Minister for Planning has now approved Amendment C169 to the Ballarat Planning Scheme.

The Amendment amends the Schedule to Clause 52.03 to provide site specific use and development of an education facility and amends the Schedule to Clause 81.01 to introduce ‘Ballarat and Queen’s Anglican Grammar School Foundation Ltd, Lot 2 (PS622085) Gillies Road, Mount Rowan, 9 April 2013’ as an incorporated document.

and free of charge, during office hours, at the offices of the Ballarat City Council, Town Hall, 225 Sturt Street, Ballarat.

Request to the Minister for Planning

After considering submissions received during the informal consultation period to the above amendment, Council resolved at its meeting on 10 April, 2013 to refer the amendment to the Minister for Planning.

Council has requested that the Minister for Planning authorise, prepare and approve Amendment C169 to the Ballarat Planning Scheme under the provisions of section 20(4) of the Planning and Environment Act 1987.

What has happened

Council received an application from Ballarat Grammar to establish an educational facility at its property located at Lot 2 Gillies Road, Mount Rowan. 

Council considered this matter at its meeting on 26th September, 2012 and resolved to:

1. Acknowledge the request from Ballarat Grammar School to allow the use of ‘Education’ to become a permit required use at the Ballarat Grammar, Mount Rowan Campus (Lot 2 Gillies Road, Mount Rowan).

2. Acknowledge that the Minister for Planning’s proposed Reformed Zones recommend to make the use ‘Education’ a permit required use in the Farming Zone.

3. Require Ballarat Grammar (the applicant) to:

a) Provide Council with a consultation strategy and undertake adequate community consultation to the satisfaction of Council prior to 1 November 2012; and

b) Provide Council with an Incorporated Document setting out Ballarat Grammar’s intended site use and development for inclusion in the Schedule to Clause 52.03.

4. That a report be presented to Council following informal consultation to consider endorsement of the Incorporated Plan and if endorsed, Council write to the Minister for Planning requesting the Minister authorise, prepare and approve an amendment to Clause 52.03 of the Ballarat Planning Scheme to list the development of the Ballarat Grammar Mount Rowan Campus (Lot 2 Gillies Road, Mount Rowan) in the Schedule to Clause 52.03, using the provisions of section 20(4) of the Planning and Environment Act 1987, if the proposed changes to the Farming Zone are not implemented by 1 November 2012.
