Amendment C159 was approved by the Minister for Planning on 6 February 2013 and came into operation on 14 February 2013.
The City of Ballarat has received a combined amendment/planning permit application relating to Stockland Wendouree. The application is proposed to facilitate the upgrade and expansion, by approximately 15,000sqm, of the existing Wendouree Shopping Centre. The proposal will involve the redevelopment and expansion of the northern part of the existing centre to accommodate a new Discount Department Store (Big W), the relocation of the Woolworths Supermarket and new specialty shops.
The proposed redevelopment also makes provision for a new community facility (relocation of Council Library) on the Norman Street side which will front a new public plaza/forecourt. The proposal also upgrades road access and intersections, and the construction of new multi-level car parking. A new landscaped pedestrian link from Norman Street to Park Street will also be provided.
A retail expansion as proposed would be prohibited under the current residential zoning of the adjoining land. The amendment proposes to rezone five lots owned by Stockland, located at the north-east corner of the Wendouree Shopping Centre from Residential 1 Zone to Business 1 Zone. It also proposes to close the northern end of the Park Street road reserve and rezone it to Business 1 Zone. This will allow for expansion of the Shopping Centre. The properties to be rezoned are: 1131 and Units 1 & 2 /1133 Norman Street and 68 & 70 Park Street, Wendouree.
The combined Amendment C159 and Planning Permit were lodged by Contour Consultants, on behalf of Stockland Wendouree. This proposal was put to Council at an Ordinary Council meeting on 13 June 2012.
The combined process allows joint consideration of the permit application and the planning scheme amendment rezoning. This enables all matters to be considered concurrently rather than through two separate, subsequent processes.
Council is now seeking public comment through this formal planning scheme amendment process.

A Panel was stablished to consider submissions to Amendment C159 to the Ballarat Planning Scheme. The Panel was appointed under the provisions of sections 153 and 155 of the Planning and Environment Act 1987, and consisted of Margaret Baird (Chair) and William O’Neil. Exhibition took place between 28 June 2012 and concluded on Monday 30 July 2012. A drop-in consultation session was on Tuesday 17 July 2012. This was held from 4.00pm -7.00pm in the Trench Room, Town Hall, Sturt Street, Ballarat. This session enabled the community and interested parties to view the documents and discuss the proposal with Council officers and other representatives.
The Directions Hearing was held on Monday 1 October 2012. Various matters were discussed and a requirement for all submitters to receive a copy of the updated draft permit was directed by the Panel. See below for a copy of the updated draft permit.
