Amendment C143 was approved by the Minister for Planning on 5 November 2012 and came into operation on 15 November 2012.
The formal public exhibition period for Amendment C143 to the Ballarat Planning Scheme commenced on Thursday 25 August and closed at 5pm on Friday 23 September 2011.
The amendment proposes to re-zone 4.5ha of Farming Zone land to Residential 1 zone. The parcel of land is located at the end of Tresize Lane, Mt Clear. See outlined in red below.
Amendment C143 was lodged by Jewell Partnership. This proposal was put to Council at an Ordinary Council meeting on 24 November 2010 and was adopted. Council is now required to seek public comment through this formal planning scheme amendment process.
The land is currently zoned Farming and adjoins existing Residential 1 zoned land, along with containing a tributary of the Canadian Creek. The land is largely cleared of native vegetation and has been sporadically used for grazing. The land is degraded with extensive weed infestation, particularly along the creek tributary.
It is proposed to have approximately 20 lots ranging from 450m2 to 2000m2 on the rezoned land. Much of this detail will be decided upon during the planning permit stage, such as landscape and flood issues. Future development of this site and existing adjoining residential zoned land will include creek rehabilitation as well as extensions to the existing bike/walking path.
Changes to the Planning Scheme
To enable residential development on this land, Amendment C143 proposes to change the zone of the land from Farming Zone (FZ) to Residential 1 Zone (R1Z).
Amendment C143 also proposes to alter three of the maps in the Municipal Strategic Statement – the Overall Framework Plan (21.03), the Residential Framework Plan (21.04) and the Canadian Valley Outline Development Plan – Overall Framework Plan (21.08), in order to move the urban growth boundary to include the subject site within the area zoned for residential use in the Canadian Valley.

The public submissions made to Amendment C143 have been processed. At the Council Meeting on 23 November 2011 Council resolved to request the Minister for Planning to appoint an independent planning panel to consider all submissions. A Planning Panel was appointed to hear submissions to Amendment C143. A Directions Hearing was held on 3 February 2012. A Panel Hearing was held on Friday 16 March 2012. Council also resolved to seek authorisation to rezone the area on the east side of Geelong Road between the land subject to Amendment C143 and the boundary of the Technology Park, to Urban Growth Zone. Council will contact the affected landowners and stakeholders in due course.
Council has requested the Minister for Planning to adopt Amendment C143 and formally rezone the subject land. The timing when the formal adoption and rezoning will occur is currently unknown.
