Amendment C203 – Ballarat West Precinct Structure Plan 2012 Five Year Review

The Ballarat West Precinct Structure Plan (PSP) was incorporated into the Ballarat Planning Scheme in 2012. The PSP guides future development in Ballarat West and sets a long-term strategic framework for development in relation to land use, transport, activity centres and open space.

Council is required to monitor the implementation of the PSP every five years.

Council officers engaged Environmental Resources Management (Aust.) Pty Ltd (ERM) to undertake work surrounding the necessary review of the Ballarat West PSP. ERM have prepared the ‘Ballarat West Precinct Structure Plan (2012) Review, Planning Summary Report 2016’ (the Review), which makes recommendations to change the Ballarat West PSP and the Ballarat Planning Scheme.

Namely, the Review recommends:

        • reduction in the application of the Environmental Audit Overlay throughout the PSP area and;

        • a realignment of the Commercial/Industrial Precinct situated along Ballarat-Carngham Road

Council resolved at its meeting held on 10th August 2016 to lodge the Amendment with the Minister for Planning for authorisation to start the Amendment.

Amendment C203 Public Exhibition

The amendment is now on exhibition from Thursday 15th December 2016 to Friday 27 January 2017.


What does the Amendment do?

The amendment implements the recommendations of the Ballarat West Precinct Structure Plan Review (2012) - Planning Summary Report, 2016 (the Review) (and the supporting specialist reports Industrial/ Commercial Precinct and Noise Emissions Buffer ‐ Air and Noise Assessment, July 2016 and Potentially Contaminated Land – Contaminated Land Review, July 2016)  by amending the Ballarat West Precinct Structure Plan 2012 (BWPSP 2012), and making consequential changes to the Ballarat Planning Scheme to guide development of the PSP area.

Ordinance changes-

  • Amends Clause 21.04 to reference the updated Ballarat West Precinct Structure Plan from ‘2012’ to ‘updated October 2016’ (PSP 2016).

  • Amends Schedule 2 to Clause 37.07 (Urban Growth Zone (UGZ2) to:

    • Replace ‘Map 1 to Schedule 2 to Clause 37.07’ with a new Map 1 to Schedule 2 to Clause 37.07’ to implement the Plan 8 Future Urban Structure of the Ballarat West Precinct Structure Plan updated October 2016(BWPSP 2016), which realigns the ‘Industrial/ Commercial Precinct’ (and consequential changes).

    • Provide the responsible authority with the discretion as to whether an acoustic report for any application for the subdivision of land, use or buildings and works for sensitive land uses within the ‘Noise Emission Buffer: Night Period – No Noise Attenuation’ is required.

    • Delete the requirement for an environmental assessment for the development of land identified as having ‘Low Potential for Contamination’.

    • Amend the requirement for the development of land identified as having ‘Medium Potential for Contamination’ to apply only to the development of a sensitive use on this land.

    • Amend the Noise Emission Buffer requirement to make a Section 173 Agreement discretionary. A permit condition/s may be adequate to ensure that sensitive uses comply with noise attenuation measures.

    • Insert the ‘Ballarat West Precinct Structure Plan Review - Contaminated Land Review, 2016,Ballarat West Precinct Structure Plan Review of the Industrial/Commercial - Air and Noise Assessment, 2016andBallarat West Precinct Structure Plan (2012) Review – Planning Summary Report, 2016’as reference documents.

  • Amends Clause 61.03 to delete Planning Scheme Map No 20EAO.

  • Amends Clause 81.01 to replace the incorporated document ‘Ballarat West Precinct Structure Plan, June 2012’with the incorporated document ‘Ballarat West Precinct Structure Plan updated October 2016’. 

  • amending relevant wording to require an environmental assessment in relation to land designated as having a ‘Medium Potential for Contamination’ only when the land is to be developed for sensitive uses.

  • Amends Clause 61.03 to remove reference to 20EAO. 

  • Amends Clause 81.01 to update the title ‘Ballarat West Precinct Structure Plan 2012’ to be ‘Ballarat West Precinct Structure Plan, updated July 2016’.

Mapping changes-

  • Amends Planning Scheme Map Nos. 26EAO and 32EAO and deletes Planning Scheme Map No 20EAO to implement the revised ‘potential for contamination’ rating and delete the Environmental Audit Overlay (EAO) from various parcels of land.


Ballarat West Precinct Structure Plan changes

The Ballarat West Precinct Structure Plan, 2012 will be updated to be titled ‘Ballarat West Precinct Structure Plan, updated July 2016’. The changes within the Structure Plan consist of:

  • Amend ‘Plan 7 Environmental Issues’ of the Precinct Structure Plan to remove some properties from the ‘High Potential for Contamination’ designation and include them in the ‘Medium’ or ‘Low Potential for Contamination’ designations;

  • Amend relevant wording of the Precinct Structure Plan to remove the requirement for an environmental assessment in relation to land designated as having a ‘Low Potential for Contamination’ and require an environmental assessment in relation to sensitive land uses only; and

  • Amend ‘Plan 8 Future Urban Structure’ and ‘Plan 11 Housing’ of the Precinct Structure Plan (and make consequential changes to other relevant plans of the Precinct Structure Plan) to vary the alignment of the ‘Air Emissions Buffer Area’ and associated ‘Industrial/ Commercial Precinct’;

  • Amend relevant wording of the Precinct Structure Plan to reflect the proposed amendments to the air emissions buffer.

Any person who may be affected by the amendment may make a submission to the Council to support, object or request changes to the proposed amendment. The closing date for submissions is 5pm, Friday 27 January 2017.
