AMENDMENT C148 - RURAL LAND USE STRATEGY
The Ballarat Rural Land Use Strategy was adopted by Council in December 2010. The Strategy aims to ensure the long-term productivity and sustainable development of Ballarat’s rural areas.
The key adopted recommendations of the Strategy are a long-term vision for the municipality’s rural areas, formulation of a new policy and modified planning controls for assessing housing and subdivision in the Farming Zone. The Strategy does not facilitate rezoning requests for individual landowners. The draft 'Rural Areas Review' (2008) was used as a foundation for the Ballarat Rural Land Use Strategy.

The Rural Land Use Strategy has been finalised and adopted by Council. A Planning Scheme Amendment will now take place to implement the changes into the Ballarat Planning Scheme.

What happens now?
In order for the Strategy’s recommendations to be converted to land use and development controls, the Ballarat Planning Scheme now needs to be updated. A process known as a Planning Scheme Amendment will now take place to update the Ballarat Planning Scheme.
This is a lengthy process whereby the State Government must assess the land use and development controls being put forward by Council.
An important step in the Planning Scheme Amendment process is the exhibition phase.The formal public exhibition period for Amendment C148 has taken place from Thursday 28th July to Friday 9th September 2011.
The public submissions made to Amendment C148 were presented to Council for consideration on 9 December 2011, with Council resolving to:
1. Note the extensive work of the Ballarat Rural Land Use Strategy along with the consultation to date;
2. Note that the Ballarat Rural Land Use Strategy will provide an overarching strategic direction for the management of rural land across the City of Ballarat and that all planning matters in rural areas will be determined on their merits and with regards to state and local policy;
3. On considering Ballarat Planning Scheme Amendment C148 (Rural Land Use Strategy), request the Minister for Planning to appoint an independent Panel under Part 8 of the Planning and Environment Act 1987 to consider all submissions;
4. Refer all submissions, including late submissions, to the Panel in accordance with section 23(1)(b) of the Planning and Environment Act 1987;
5. Submit to the Panel its response to the submissions as outlined in this report and seeks minor modifications to the amendment in Council’s submission to the Panel listing of two additional work items in Clause 21.09 of the Ballarat Planning Scheme
This independent Panel process is likely to take place in early – mid 2012, at which time Planning Panel’s Victoria will appoint the Panel to hear all submissions and contact each person who made a submission, advising them of the next steps in the process.
