Amendment C123 - Anomalies


What is proposed?

Ballarat Planning Scheme Amendment C123 seeks to rectify various anomalies identified within the Ballarat Planning Scheme in order to maintain the Scheme's accuracy. The amendment affects a number of sites within the municipality and various written components of the Ballarat Planning Scheme.

Anomaly amendments are routine matters which are necessary to ensure the accuracy of the Planning Scheme and to clarify the intention of provisions. An accurate and easy to interpret planning scheme assists in the delivery of better planning decisions.

On 4 September, 2009, Council approved Planning Scheme Amendment C123 pursuant to Section 35B of the Planning and Environment Act 1987. The amendment was gazetted on 24 September, 2009 and is now part of the Ballarat Planning Scheme.

Anomalies in the following components of the Ballarat Planning Scheme have been rectified:

a) Zone mapping for 5 Anderson Street East, and 5 Steinfeld Street North, Ballarat Central;

b) Zone mapping for 3-15 Errard Street North, 710 and 802 Mair Street, and 102A and 1/106 Drummond Street North, Ballarat Central;

c) Development Plan Overlay mapping for Schedule 5 to the Development Plan Overlay - Ballarat Golf Club Redevelopment.
The mapping has been amended to correct the reference on the mapping of Schedule 5 to the Development Plan Overlay, from ‘DPO2' to ‘DPO5';

d) Design and Development Overlay mapping for DDO1 - Bridge Mall;

e) Municipal Strategic Statement, Clause 21.08 - Reference Documents.
This clause has been amended to include the correct the title of the reference document, ‘Outline Development Plans for Urban Development Areas at Brown Hill, Shire of Bungaree';

f) ‘Business' local policy at Clause 22.03;
This clause has been amended to correctly identify the extent of the Ballarat Health Precinct, and reinstate text inadvertently omitted from the previously approved clause (refer to Ballarat Planning Scheme Amendment C92).

g) Schedule 3 to the Special Use Zone - Sovereign Hill;

h) Schedule 7 to the Design and Development Overlay - Urban Character Area 11; and

i) Schedule to Clause 66.04 - Referral and Notice Provisions - Referral of permit applications under local provisions.

The clause has been amended to ensure that the Roads Corporation (VicRoads) is recognised as a referral authority for planning permit applications triggered by Schedule 2 to the Design and Development Overlay - Western Highway - Leigh Creek to Woodmans Hill.
