Proposed New Local Law  – Meeting Procedure Local Law 18

Pursuant to Section 119(2) of the Local Government Act 1989, notice is hereby given that at its 12th October 2011 meeting, the Ballarat City Council proposed to make Meeting Procedure Local Law No. 18 in order to effect various amendments to Meeting Procedure Local Law No. 16. The objectives of the Local Law are to: 

  1. provide for the election of the Mayor and Deputy Mayor;
  2. regulate the use of the Common Seal;
  3. prohibit unauthorised use of the Common Seal or any device resembling the Common Seal;
  4. provide for the procedures governing the conduct of Council Meetings; and
  5. provide for the appointment of councillors to Advisory Committees, Special Committee positions and external boards.

The changes proposed by Meeting Procedure Local Law No 18 include:

  • Changes on speaking times for motions.
  • Changes on process and what is deemed as a petition.
  • Changes on purpose and process for questions by Councillors.
  • Change of time for receipt of Motions on Notice.
  • Removal of portfolio’s from Local Law as it is a separate endorsed process of Council.
  • Removal of definitions not relevant to the Local Law.
  • Changes to formatting.
  • Update Mayor and Deputy Mayor election process to ensure it meets the Assembly process under the Local Government Act.
  • Reference to Local Government Act or other legislation.

Copies of the proposed Meeting Procedure Local Law No. 18 can be obtained from the Phoenix Building, Armstrong Street South, Ballarat during normal office hours or via Council’s website www.ballarat.vic.gov.au.

Any person can make a submission to Council in relation to the proposed Local Law.  Any person affected by the proposal may make a written submission in accordance with Section 223 of the Local Government Act 1989.

All written submissions must be received by 5 pm Monday 14th November 2011. Any person who has made a written submission must request in that submission if they wish to be heard in support of their submission before a future Council Meeting.

Local Law No. 12 - Saleyards

The purpose of this Local Law is to:

  1. to provide for the administration and management of the Ballarat Livestock Selling Centre (also known as the Central Victorian Livestock Exchange (CVLX) by conferring discretionary authority on the Manager to manage the Saleyards on Council's behalf.
  2. to assist in the documentation of procedures and the expectations of Saleyard users such that accreditation to NSQA can be achieved.
  3. to enable the Manager to set and collect fees from vendors selling stock in the Saleyards and to prescribe the level of those fees.
  4. to enable the Manager to prescribe the days and hours during each day on which sales can be held at the Saleyards.
  5. to protect Council assets and facilities at the Saleyards.
  6. to promote and enforce appropriate adherence to occupational health and safety practices at the Saleyards.
  7. to control and prevent behaviour which is a nuisance, or which may be detrimental to health and safety.
  8. to control the use of dogs at the Saleyards.
  9. to regulate smoking and the consumption of alcohol at the Saleyards.
  10. to provide for the administration of Council's powers and functions.
  11. to control the quality of livestock products through the fair and reasonable treatment of animals and the application of adequate animal husbandry practices.

Local Law No. 16 - Meeting Procedure

The purpose of this Local Law is to:

  1. provide for the election of the Mayor.
  2. regulate the use of the common seal.
  3. prohibit unauthorised use of the common seal or any device resembling the common seal.
  4. provide for the procedures governing the conduct of Council meetings and Special Committee Meetings.
  5. clarify the role of Portfolio and Lead Councillors.

Local Law No. 15 - Community Local Law (as amended by Local Law No. 17)

The purpose of this Local Law is to:

  1. provide for the peace, order and good government of the municipal district of the City of Ballarat.
  2. provide a safe and healthy environment, in which the residents of the municipality enjoy a quality of life that meets the general expectations of the community.
  3. control and regulate emissions to the air in order to improve the amenity, environment and quality of life in the municipality.
  4. ensure that the public can properly use and enjoy public reserves by regulating activities and behaviour in public reserves.
  5. prohibit, regulate and control the consumption of alcohol in designated areas within the municipality.
  6. manage, regulate and control the different uses to which roads, Council land and footpaths can be put to ensure that there is a proper balance between private uses and the need to maintain freedom of movement for the public.
  7. manage, regulate and control the keeping of animals and birds.

Local Law No. 17 - Community Local Law (amending Local Law No. 15)

The purpose of this Local Law is to:

  1. Act as an amending law to the existing Local Law No. 15.
  2. Provide for an amendment to the 'Permit to Burn' clause to reduce the size of land for which such a permit is required.
  3. Introduce a requirement for businesses with shopping trolleys to utilise trolleys with coin-lock mechanisms from 1 July 2011 onwards.
  4. Create an offence for the disposal of household or business waste in public litter bins.
  5. Introduce a law requiring a permit to conduct any fireworks display.
  6. Amend the wording in Asset Protection Permits to enable officers to use their discretion as to whether to require payment of a bond prior to the issue of a permit.
